Federal Court declined to grant Application to Stop the NPF from Extraditing Abba Kyari



A Federal High Court in Abuja declined to grant an ex parte application to stop the Nigeria Police Force (NPF) and the Attorney-General of the Federation (AGF) from arresting and extraditing suspended Deputy Commissioner of Police (DCP), Abba Kyari.

The Trustees of Northern Peace Foundation’s application was rejected by Justice Ahmed Mohammed on Thursday, August 19.

The foundation, through its legal team led by Dr. Olukayode Ajulo, had prayed, via a de novo application, to the judge for a temporary order against the two defendants pending the hearing and final determination of the substantive suit. A 21-paragraph affidavit of urgency accompanied the application dated August 9.

The judge, after carefully listening to the counsel, refused to grant the request to stop Kyari’s arrest and extradition through ex parte means.

In its place, Justice Mohammed ordered the counsel to turn the ex parte motion into a motion on notice and serve it on NPF and AGF.

In addition, the judge ordered the applicant to serve all court documents on the two respondents. After that, he fixed September 9 for the case to be discussed.

The Federal Bureau of Investigation FBI allegedly indicted DCP Abba Kyari in an alleged multi-million naira advanced fee fraud allegedly committed by a Nigerian, Ramon Olorunwa Abbass, known as Hushpuppi.

The Police Service Commission (PSC) has set up an in-house committee to examine the documents related to the suspended DCP, a former head of the Intelligence Response Team (IRT) of the National Police Force accused in a report by the Federal Bureau of Investigation (FBI).

Ikechukwu Ani, the PSC spokesman, said that the panel is expected to examine the FBI indictment, as well as the existing rules, to keep abreast of this matter until the court decides.
